These terms and conditions apply between you and CPLeasing Ltd for the acquisition via various funding options of UK vehicles listed on our website, and is supplied by recommended dealers/manufacturers.
1. Orders
Your order of a vehicle from the CPLeasing website is an offer by you. All orders are subject to acceptance by CPLeasing, availability, price changes and the payment of a deposit in accordance with your signed order. If the vehicle you have ordered is not available, CPLeasing will contact you by email or telephone to provide possible alternatives. If the vehicle is available and CPLeasing accepts your offer then CPLeasing will contact you to request payment of the deposit in accordance with your signed order.
2. Prices
1. The prices quoted include VAT if personal leasing and does not include VAT if business leasing, delivery by the dealer to your chosen UK mainland destination, number plate, Road Fund Licence for the term ( if applicable ) and Vehicle Registration Charge.
2. CPLeasing reserves the right to change the price either before or after CPLeasing accepts any order. CPLeasing shall notify you of such a change and you have the right to cancel your order if the change is not acceptable.
3. Prices on the web site are for information purposes only and do not constitute an offer by Nationwide capable of an acceptance by you.
4. Upon agreement by both parties and the relevant order form signed by you, and after finance acceptance has been confirmed a non refundable deposit of £500 plus VAT (If VAT is applicable) will be taken by credit/debit card, bank transfer, or cheque.
3. Cancellations
3.1 The Company may cancel the Customer's order if any of the following occurs:
(A) the manufacturer or third party supplier ceases to supply the type of Vehicle ordered;
(B) the Order Form has been accepted by the Company upon the basis of a substantive error in relation to any term of the Order Form including a typographical or mathematical error with respect to the Price or Specification;
(C) the Customer materially breaches any term of this Agreement, including failure to make any payments when due or payments being refused by the Customer's bank or credit card company;
3.2 If the Company cancels the Customer's order pursuant to paragraph 3.1 (C) of this Agreement, then the Company will try to find an alternative buyer for the Vehicle. If the Company cannot find an alternative buyer, it reserves the right to forfeit some or all of the Customer's deposit as compensation for any losses caused directly by the Customer's breach (without prejudice to the Company's right to recover from the Customer by way of damages any loss or expense which the Company may directly suffer or incur by reason of the Customer's default).
3.3 The Customer may cancel his order:
(A) if the Company materially breaches this Agreement;
(B) if the Order Form has been formed upon the basis of a substantive error in relation to any term of the Order Form including a typographical or mathematical error with respect to the Price or Specification; or
(C) in the circumstances outlined in paragraph's 3.1 (A) and (B) of this Agreement.
3.4 In addition, the Customer has a right under the Consumer Protection (Distance Selling) Regulations 2000 ("the Regulations") to cancel his order for any reason without charge. This cancellation right begins on the date the Confirmation Form is sent by the Company and ends on the expiry of the period of 7 working days beginning with the day after the day on which the Customer takes delivery of the Vehicle. Any monies the Customer has paid will be returned.
Delivery/Registration
1. Upon receipt of correct finance documentation and any balance of monies CPLeasing will arrange delivery of the vehicle to your chosen destination.
2. Local registrations of vehicles are not possible.
Statutory Rights
1. Nothing in these conditions shall affect your statutory rights.
2. CPLeasing is committed to customer service. Should you have any complaint about the CPLeasing service, we will endeavour to resolve them in a fair and effective manner.
3. Please inform CPLeasing by email at sales@cpleasing.co.uk should you have any complaint about our service. We are committed to acknowledging your complaint within 48 hours of receipt and undertaking all reasonable efforts to resolving it promptly under the circumstances. We will provide you with a timescale for resolving the dispute and keep you regularly updated with its progress.
3.5 In the event of cancellation the Company shall be entitled to change a fee of 3 months rental plus Vat in respect of its costs in processing and dealing with that order.
